Mining Law

The Government of the SADR is committed to the responsible stewardship of the country’s natural resources and providing an attractive and stable fiscal and legislative framework to attract mining investment.

On 26 May 2014 the SADR Parliament adopted a new Mining Law (Law No. 02/014). The Law outlines the terms of Exploration Permits, Mining Permits, Small-scale Mining Permits and Infrastructure Permits.

Exploration Permits allow for the exclusive exploration of all minerals within a permit area. An Exploration Permit may cover an area of up to 2,000km2 and a permit holder may hold up to 10 permits. An Exploration Permit is valid for an intial period of 3 years and is renewable twice each for a further 3 years.

Upon demonstration of an economically viable mineral deposit an Exploration Permit holder may apply to convert the deposit area into a Mining Permit that is valid for 30 years and is renewable twice each for a further 10 years.
